Jammu and Kashmir High Court demands Government to ensure vaccination of disabled persons.

On 30th June 2021, the Jammu and Kashmir High Court instructed the Centre and Jammu and Kashmir Government to take effective measures as per the Centre’s guidelines for vaccinating disabled persons.

A single Judge Bench of Justice Ali Mohammad Magrey also ordered the Additional Chief Secretary, Health and Medical Education Department of Jammu and Kashmir Union Territory to file an affidavit by the next date or before the next date of hearing specifying steps for Vaccination of disabled persons in the Union Territory.

A petition was filed by Javed Ahmad Tak on behalf of Humanity Welfare Organization Helpline, for disabled persons. The petitioner seeks instruction from the Government to regard all the persons with disabilities as a special category and make sure their vaccination is done as per the policy of the Government of India, Ministry of Health and Family Welfare, and the Government of Union Territory of J&K

The petitioner referred to the Rights of Persons with Disabilities Act, 2016 and said that the legislation empowers all disabled persons with certain benefits on a priority basis. He stated that despite approaching the authorities, no effective action was taken for the vaccination of disabled persons in Jammu and Kashmir. This has formed a ground for seeking the indulgence of the Court in the petition.

The matter will now be heard on July 8th.
