Sessy Xavier, who has been alleged of practising as an Advocate for two years without a Law Degree has approached the Kerala High Court for the grant of anticipatory bail in the matter.
Sessy Xavier had been practising as an Advocate without having been enrolled in the State Bar Council, even without completing her LLB degree. She had been practising as an Advocate in the Courts of Alappuzha District in Kerala for two years. During enquiry conducted based on an anonymous letter, the Kerala Bar Council came to know that Sassy Xavier had been using the enrollment number of another Advocate who was practising in Thiruvananthapuram. She has also contested in the bar association election where she won the post of librarian.
After a complaint was filed against her, she went into hiding. On the 23rd of July 2021, Sessy Xavier appeared before the Chief Judicial Magistrate with regard to the charges which had been filed against her. It is said that she was under the impression that she would be released on bail. On realizing that she had been charged with non-bailable offences and that she would not be granted bail on that day, she fled from the Court. The Police have registered an FIR against her under sections 417, 419 and 420 of the IPC. It was also reported that she misplaced some rare documents belonging to the association library. The police have also charged her with theft under section 379 of the IPC.
Members of the Alappuzha Bar Association have denied appearing for her before the Court, and Advocate Roy Chacko will be representing her case.
Alappuzha North Police have registered a case under sections 417 and 419 of the IPC based on the complaint lodged by the bar association. Secretary Abhilash Soman claimed that she did not possess the necessary qualification as a practising advocate, and hence be arrested for impersonating her as an advocate. It was also reported that Xavier misplaced some rare documents belonging to the library. Therefore, police also charged the offence of theft against her.
